Acceptable Use Policy

Draft, not reviewed by a lawyer

This document was written to reflect how the software actually works and to cover the obligations a small Canadian software business would normally address. It has not been reviewed by a lawyer, and it should be before this company takes on a material customer. If you are relying on this for anything, talk to us first.

This policy sets out what you may not do with Sitka Systems. It is part of the Terms of Service, and exists because a short list in the main agreement is not enough room to be specific about the things that actually come up: staged-photo disclosure, advertising content rules, and other tenants' data among them.

1.What this policy covers

This Acceptable Use Policy is part of our Terms of Service and applies to everyone who holds a seat on a Sitka workspace, whatever their role. A breach of this policy is a breach of those terms, and can result in suspension or termination of access as the Terms describe.

The short version: use Sitka to run your own real estate practice, for the people who work with you, and do not use it to reach data, capacity, or people it was not given to you for.

2.Content and advertising

Do not use Sitka's AI tools to generate, and do not send or publish, content that:

  • Misrepresents a property. This includes presenting a virtually staged photo as an unedited one, cropping out or obscuring the staging disclosure watermark or the disclosure line Sitka adds to listing copy, or describing a property's condition, size, or features inaccurately.
  • Violates the advertising standards or rules of conduct your real estate regulator or board holds you to. Sitka drafts copy; you remain the licensed professional responsible for what you publish under your name and licence.
  • Discriminates against, or expresses a preference based on, a protected characteristic in a way that would breach human-rights or fair-housing style restrictions on real estate advertising, including characteristics such as family status, source of income, disability, or others protected under the BC Human Rights Code and equivalent federal law. Do not prompt the AI tools to produce this content, and do not send it if a draft comes back containing it.
  • Infringes someone else's copyright or trademark, including photographs, floor plans, or text you do not have the right to use.

3.Other people's data, and your own clients'

Do not:

  • Upload a document, photo, or record that you do not have the right to upload, including someone else's confidential or copyrighted material.
  • Upload government identification, Social Insurance Numbers, banking or payment credentials, or health records. Sitka is not built to hold these, and putting them in does not make them secure.
  • Send commercial email through the product to anyone who has not given the consent CASL requires, or who has withdrawn it, or who has unsubscribed.

4.The platform itself

Do not:

  • Attempt to access, extract, or infer another tenant's data, by any means, including probing the API, manipulating identifiers, or attempting to defeat the tenant-isolation controls described in our Security page.
  • Test the security of the service (penetration testing, vulnerability scanning, or similar) without our prior written permission. If you have found a real vulnerability, report it as described in our Security page instead of testing it further.
  • Scrape, crawl, or use automated tools against the product outside the normal use of its own interface and documented integrations.
  • Reverse engineer the service or use it to build a competing product.
  • Attempt to circumvent usage allowances or rate limits, including by sharing a seat between multiple people, scripting repeated requests, or automating calls to the AI tools outside the product's own workflows.
  • Resell, sublicense, or provide access to Sitka's AI tools to anyone who does not hold a seat on your workspace, including offering it as a feature of your own product or service.
  • Use the contract annotation tool, or represent a document exported from it, as an executed or legally binding document. It annotates PDFs. It does not capture signatures and does not run a signing workflow.
  • Use the contextual assistant as a general-purpose chatbot unrelated to your workspace's clients, listings, and documents, or attempt to extract its underlying prompts or instructions for use elsewhere.

5.Enforcement

Where we reasonably believe it is necessary to protect the service, another tenant, or someone whose personal information is at risk, we may suspend access immediately, remove content, or both. We will tell you why, and restore access once the cause is resolved, except where the conduct is serious enough that we end the agreement instead, as the Terms describe.

To report misuse of the product, or a security vulnerability, email legal@sitkasystems.ca or legal@sitkasystems.ca (the same address). See our Security page for how we handle a vulnerability report.
